Q77. Paper or Prophetic Examples
 In the U.S., chemical patent applications often contain a mixture of examples which have actually been carried out and examples which are prophetic (or “paper”) examples. Do “paper” examples improve the acceptability of the Japanese patent application?

A77. No. The “paper” or prophetic examples do not either improve the acceptability of the Japanese patent application; or create a specific problem. The JPO does not accept “paper” examples only. In addition, it is not possible to add to the specification, any data obtained by actually carrying out the prophetic examples, after the filing date of the application, as constituting new matter.
